In New Jersey, most of us work on contingency. That means that we’re paid contingent upon success, meaning that if you don’t get paid, we don’t get paid. The only area that sometimes depends on the attorney you contact is who pays for the expenses of the case. Certainly, I advance all expenses on motor vehicle accidents, and that means everything from the simple things up front to getting the police report, your hospital records, and the filing fees. At the end of the day, assuming we’re successful, the expenses will be deducted first, and then there is a split that is generally one-third or something less than that depending on the situation. Basically, if you don’t get paid, we don’t get paid, and you don’t owe us anything.
You certainly can do it on your own. Insurance would love to handle everything. Unfortunately, it is very likely that you will be taken advantage of. You do not know what the values are here in New Jersey, and the insurance companies are simply not afraid of you at all because they know that you’re not an experienced attorney. Your only options are either to hire an attorney or try to handle the case in court yourself. That is not something you do on a regular basis, but the insurance company lawyers certainly do, and they know that.
Specialization and personal service. This is the only kind of work I do. I don’t know anything at all about wills, divorces, criminals, corporations, or the million other things that are out there. I only know about representing injured people one at a time. That’s what I have been doing for 30 years. I do all my own work and I don’t rely on younger, less experienced attorneys hired by me.
I think it’s important that a client continues to speak to different attorneys until they find somebody who’s willing to sit down with them on a face-to-face basis and explain how everything is done from beginning to end, and who really takes the time to make them feel comfortable and gives them that connection that’s necessary. Ultimately, you’re going to have to trust that person to do everything that can be done on your behalf.
