While malpractice can occur with any condition, illness, or other reason that people seek health care or medical treatment for, listed below are some of our special areas of focus.

Birth Injuries & Obstetric Malpractice
Tragically, what should normally be one of the happiest days in a parent’s life sometimes goes wrong due to negligent or inappropriate care given by a physician.

Common occurrences we see include:

  • Shoulder Dystocia
    This occurs to infants during birth when the doctor fails to recognize that the baby is too large or attempts to pull a baby through the birth canal with too much force. If the infant’s brachial plexus nerve - which runs between the head and the shoulder - is stretched or torn in this process, brachial plexus nerve injury is the result. This nerve injury is known as Erb’s Palsy and/or Klumpke’s Palsy.

    In some cases, the arm will be limited in use and significantly shorter than the unaffected arm. In more severe cases, there can be a total loss of use, shortening and atrophy.

  • Infant Brain Damage
    Permanent brain damage may result to an infant during birth due to a lack or inadequate supply of oxygen known as asphyxia or anoxia. In many cases these occur as a result of fetal distress not being diagnosed in time, or at all, by the obstetrician.

  • Pre-Eclampsia / Eclampsia
    Formerly known as toxemia of pregnancy, pre-eclampsia can lead to an eclamptic seizure, at or near the time of birth.  Serious and preventable injuries can also occur to the mother during childbirth. An eclamptic seizure can occur during birth when the mother experiences a rapid rise in blood pressure that, when untreated, can result in seizures, brain damage, and death.

Malpractice Related to Surgical Procedures
A multitude of things can go wrong during a surgical procedure and for a number of different reasons. But some of them don’t have to and are the direct result of negligence or mistakes made by the surgical team. These include:

  • Laparoscopic surgical mistakes during gall bladder surgery, known as a cholecystectomy procedure can result in the cutting of the common bile duct leading to sepsis and possible death.
  • Anesthesia-related negligence due to the inattention or inappropriate type or amount of anesthesia given can result in coma, permanent brain damage, and death.

Whenever a healthcare provider such as a physician or a nursing home deviates from the accepted standard of care and/or fails to diagnose an obvious illness or condition which causes an individual to suffer harm as a direct result, medical malpractice or negligence has occurred.
